MS4 Report presents Oct. 6-7, 2021 in 18 words: 

"Due to an extreme flooding event in October 2021, the emergency spillway embankment at Howard Lake was damaged." 

No mention of 390 properties flooded

or a disaster declaration

or more than $1,800,00 of tax dollars for repairs.  

 On February 6, 2023 during the council meeting, Mr. Rice justified annexation and repairs on Lake Forest Circle with two points.  First, the important bio-diversity of the Cahaba River.  Second, the city’s obligation to maintain the National Pollutant Discharge Elimination System (NPDES) permit. One requirement of that permit is the MS4.  

NPDES is designed to “to control the quality of stormwater discharged to the storm drains and thence to waters of the United States” (EPA) 

ADEM as part of a consent agreement has fined US Steel and the Preserve two times in two years for failure to enact BMPs. 

MS4 an official report, representing our city, says

"Building sites are inspected at least once a month." 

Logically, Hoover should have identified and help US Steel correct those problems before ADEM was involved.
