The council is holding a special meeting to approve the January 18, 2022 meeting minutes...again and in more private circumstances.
The council approved the January 18, 2022 minutes on February 7. The minutes recorded the vote as 4-3 when one council member was absent (so the vote could only total to 6) and the 7th vote changed the outcome. The Ordinance had previous litigation and the homeowners were ready to sue again. May 16 the council was ready to pass the amended agenda (where the vote was corrected) when it was pointed out that the ordinance number was still incorrect. So, they continued the item, and now are holding a special meeting with only that item on the agenda. If the original minutes stood uncorrected Walmart could come back to the city and demand the changes to their conditions because of the error. This seems to be a pretty egregious error, but in the May 16 meeting the clerk said it was a "typo". Since the January 18 minutes were removed from the website, there is not a way for the public to determine the extent of the error unless they had previously downloaded the minutes, which we did.
Mr. Murphy voted "yes" but was absent
The Ordinance number was 22-2547 in the Title but 21-2545 later. The vote count was recorded as "did not pass" but the vote recorded was 4-3.
The vote was actually 3-3 and did not pass was correct but as a public record this is rather disturbing.
